Database Rights Legislation

Following a review of the protection of Databases accross the whole of the European Community, it was found that Databases were not sufficiently protected in all Member States by existing legislation or where protection was in place, the protection had very different attributes.

As a result of this review, the European Parliament and the Council adopted a Directive on the Legal Protection of Databases (96/9/EC) and the UK brought into force and effect, the provisions of this Directive through the implementation of the Copyright and Rights in Databases Regulations 1997 (as amended) (SI 1997/3032) which came into force on 1 January 1998.
